Is my organisation on the Supporting Independence framework?

You will need to know whether you have been successfully accepted onto the Supporting Independence framework. Your organisation would have been told in August 2017 whether you have been accepted.

What is the contract replacing?

The contract is for ‘new care plan business’ only – until and unless anything different is agreed with each provider.

The Supporting Independence Framework contract will encompass a number of types of support previously commissioned under separate arrangements, which include:

  • Community Based Support (non CQC regulated) – previously known as type 1 under the Framework Agreement
  • Spot ‘Enabling’ contracts (non CQC regulated)
  • Community Opportunities for People with Mental health needs – previously commissioned in the form of block contracts
  • Services previously commissioned under the ‘Buildings Based’ Day Opportunities Select Supplier List, for all adult Service User groups (Physical, Sensory, Learning Disability, Older People)

How does the contract work?

There are two Lots to the contract:

Lot 1 is for Group Based Care and Support.

Lot 2 is for Individualised Care and Support.

Lot 1 (Group Based Care & Support): Providers will be invited to submit price and quality responses in respect of the Tender. These will be used to create a list that will show the prices for each provider; every provider on it will have met the quality threshold set.  In a process completely separate to the Tender prices submitted by bidders, eligible clients will be offered a Personal Budget. Where a decision is made to use that Personal Budget to purchase Group Based Care and Support, a package will be purchased from any provider on list, within the client’s affordable range. In the event that a client doesn’t express any choice then the practitioner will use the list to choose on behalf of the service user the lowest priced provider that is able to meet the client’s assessed needs.

Lot 2 (‘Care through the front door’, or individualised support): Providers will be invited to submit price and quality responses in respect of the Tender. For the ‘Individualised Care and Support’ Lot the pricing element of each bidder’s response will be used to create a price based ranked order to the Framework. A client’s package of care will be offered to all of the providers on this Framework simultaneously. Providers on the Framework will be able to respond with their availability, and call off will be determined on the basis of the pre-determined ranked order of price. Eligible clients will therefore have care packages arranged for them delivered by the lowest priced provider on this Framework that has availability.

What is outcomes based commissioning?

Although the council has plans to develop ‘outcome based commissioning’ and ‘independent service fund’ arrangements in the future, the Supporting Independence contract remains ‘time and activity’ based.

The council’s plans to develop ‘outcome based commissioning’ arrangements are being taken forward through other contracts. However, participation in that development is not restricted to those providers. Supporting Independence providers interested in being part of this development, or part the independent service fund development should contact the business relations team.

The Supporting Independence contract is outcome focused. The difference between ‘outcome based commissioning’ and ‘outcome focused’ is that outcome based commissioning refers to an agreement under which a provider’s payment arrangements are specifically and exclusively based upon the delivery of pre-determined outcomes. An outcome focused contract on that other hand, is one where the outcomes needing to be delivered are part of the specification and delivery requirements. But, that the payment part of the agreement can continue to be based upon a more traditional ‘time and activity’ arrangement. Under an outcome based commissioning arrangement, a provider’s payment arrangements are directly dependent upon the delivery of the outcomes. Under an outcome focused contract, as long as the agreed time and activities had been delivered, provider would be guaranteed payment, and any failure to deliver the specified outcomes would be a matter of ongoing contract management.
