Who is collecting and using your personal data?

Devon County Council (DCC) is collecting and or processing your personal data as a Data Controller under Data Protection Legislation and our ICO registration number is Z6475582. This privacy notice concerns the processing of personal data that takes place by the Public Rights of Way Team.

This privacy notice was last updated on 2 January 2024. What information are we processing?

When managing and maintaining the public rights of way in Devon, we collect the following personal information when you provide it to us:

  • Your name.
  • Your contact details (postal address, telephone numbers, email address).

Why are we collecting your personal data?

We may collect your personal data for one or more of the following purposes:

  • Agreements.
  • Consultations.
  • Deposits and grants.
  • Legal notices, orders and court actions.
  • Path maintenance and improvements
  • Statutory registers.
  • Volunteering and the Parish Paths Partnership Scheme.

The legal basis for us collecting your personal data

The following legislation provides Devon County Council with an official duty to process your personal data.

  • Countryside and Rights of Way Act 2000.
  • Highways Act 1980.
  • Road Traffic Regulation Act 1984.
  • Town and Country Planning Act 1990.
  • Wildlife and Countryside Act 1981.

On this basis, we rely upon Article 6(1)(e) of the UK General Data Protection Regulation (UK GDPR) as the lawful grounds to process your personal data.

Personal data that is collected for any of the purposes outlined in this notice is never used for direct marketing purposes and is not sold on to any other third parties.

Recipients or categories of recipients that we may share your personal data with

To enable us to deliver services to you, it may be necessary for us to share your personal data with one or more of the following organisations:

  • DEFRA.
  • Department of Transport.
  • Devon and Cornwall Police.
  • District councils.
  • Environment Agency.

International transfers

Devon County Council does not intend to transfer your personal data to countries outside of the scope of UK data protection laws. If such a transfer should become necessary in the future, we will ensure that adequate safeguards are applied to such transfers, in accordance with our obligations under Chapter V of the UK General Data Protection Regulation.

How long will we hold your personal data?

We will retain your personal data for only as long as is necessary, and in line with our organisation’s record retention schedules.

Under Data Protection Legislation, you have the right to obtain a copy of their personal records held by us, this is called a Subject Access Request (SAR).
