North Devon car trader fined for breaching Community Protection Notice

The owner of a Barnstaple car sales company has been ordered to pay more than £1,300 following two breaches of a Community Protection Notice (CPN).

Mr Alex West, of BC Autos South West, Bickington Road, Barnstaple, pleaded guilty to two offences at a North and East Devon Magistrates Court hearing on Tuesday 15 May 2018.

The CPN, put in place by North Devon Council in February 2017, required Mr West not to place vehicles that do not have a valid license or MOT certificate – or are unregistered or unroadworthy – on the public highway, or on private land without the landowner’s permission.

Mr West was charged for breaching the notice on two occasions by parking an unlicensed vehicle in North Lane, Bickington, in January 2018, and providing a vehicle to a customer as a loan vehicle in December 2017 that did not have a current licence or MOT.

The court heard that Mr West had previously breached the CPN and been convicted of three breach offences in November 2017.

North Devon Council’s Executive Member for Environment, Councillor Rodney Cann says: “The council takes this sort of antisocial offence extremely seriously; it is completely unacceptable for anyone operating as a business to use the public highway and private land in this way. I sincerely hope this recent prosecution will send a strong message to others that we will continue to deal robustly with individuals and traders who don’t comply with the legislation, which exists to protect the quality of life of those in the community. I would like to encourage members of the public to contact us if they have any information on abandoned vehicles or this sort of practice.”

Mr West was fined the sum of £600 for the first offence, with no separate penalty for the other offence and was ordered to pay the sum of £660 to cover the council’s cost in full. He was also ordered to pay a victim surcharge of £60.
