Officer Decisions

Head of Planning, Transportation and Environment - Dave Black

Summary of Matter or Issue Requiring Decision:

Publication of draft modifications to the Pre-submission Consultation Devon Minerals Plan.

Decision Taken:

Approval for publication of draft modifications to the Pre-submission Consultation Devon Minerals Plan following discussion with the Chairman of Development Management Committee.

Summary of Reason(s) for Decision Taken:

At its meeting on 27th January 2016, the Development Management Committee resolved [*106] that the Head of Planning, Transportation and Environment be given delegated authority, in discussion with the Chairman, to prepare schedules of main and additional modifications for consideration by the inspector appointed to examine the Minerals Plan.

Following receipt of the inspector’s list of issues and questions, schedules of main and additional modifications have been prepared to address the matters raised by the inspector, together with matters raised by objectors to the Minerals Plan pre-submission consultation.  These schedules of modifications have been published on the Council’s website and provided to the inspector and participants in the examination hearings.

Summary of Alternatives or Options considered and rejected:

The Council has the option of not drafting modifications and relying on the inspector to prepare modifications.  However, this would risk prolonging the examination hearings and limit the Council’s influence on the modifications, and this option is therefore rejected.

Details of any conflict of interest and dispensation granted to the Officer taking the decision or by any Member of the Council in delegating responsibility for any specific express delegation:

None
