Officer Decisions

County Solicitor - J Shadbolt

Summary of Matter or Issue Requiring Decision:

Initial Assessment of Complaint made against a County Councillor in accordance with the Council’s Guidance/Procedure

Decision Taken:

To take no further action in respect of the complaint, following consultation with an Independent Person appointed by the Council  in line with the procedure at:

https://www.devon.gov.uk/index/councildemocracy/county_councillors/councillorcomplaints.htm

Summary of Reason(s) for Decision Taken:

No evidence to support any allegation that the subject member had failed to adhere to the Code of Conduct or of any sufficiently serious potential breach that might warrant a full investigation; that the actions of the subject member were entirely proper and could not have resulted in any breach of the Code; and that a number of  the issues raised by the complainant would not in any event  meet the requiremt to warrant further action and should have been pursued under the Council’s separate complaints procedures.

Summary of Alternatives or Options considered and rejected:

All complaints must be assessed to see whether the alleged behaviour falls within the Code of Conduct; to see if there may be a case to answer or if, for example, a local settlement can be achieved or broker a conciliation between the subject member and complainant without recourse to the full process

Details of any conflict of interest and dispensation granted to the Officer taking the decision or by any Member of the Council in delegating responsibility for any specific express delegation:

None
