School absences court summons

Please provide the total number of court summons issued for school absences between 2013 to the current date sorted annually.

Please provide the number of 2nd penalty notices issued within 2 years of 1st offence. Between 2013 & current date sorted annually.  

Penalty Notices are only issued once every 2 years, if a second offence occurs within 2 years from the date the PN was issued then it will usually mean a court summons is issued.  

Devon County Council does hold this information but as disclosure may identify individuals it may breach the first principle of the Data Protection Act 1998, therefore, this information is exempt under the Freedom of Information Act 2000 Section 40 (2) Personal Data. 

Please provide the number of court summons issued within 2 years of a 1st penalty notice between 2013 & current date sorted annually. 

To collate this information, we would have to review each of the cases listed in the response to the first question to identity where penalty notices have been awarded and a court summons issued following a further offence. Even if each one only took 5 minutes the total time necessary would be in excess of 18 hours specified under the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 public authorities are not obliged to comply with requests which exceed the cost limit of £450 (equating to 18 hours of time).  For this reason we have applied Section 12 of the Freedom of Information Act (cost of compliance exceeds the appropriate limits).
