1) You are aware of the Minimum Energy Efficiency Standards and have a robust plan to enforce it (and what that plan is)

We are aware of the legislation. In the Devon, Somerset and Torbay areas the Trading Standards Service will have the enforcement role in relation to non-domestic property. However, you should contact local District Councils and Unitary authorities (including Torbay Council) for information relating to domestic properties as they will be the enforcing authority in relation to them. We are currently developing our strategy for how we will carry out appropriate work to ensure that it is complied with in the future.
We have already provided business advice guidance on our website regarding the legislation. Our Control Strategy which identifies our areas of work for 2018/19 should appear on our website in April. Further information may also be provided once project plans are finalised.

2) You will be identifying new or renewed tenancies (the trigger points of this legislation), how you will be identifying these, and how you will be cross-referencing them with EPC ratings to identify those in breach of the The Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015, for both domestic and non-domestic properties

The legislation provides for local authorities to issue and collect any financial penalties that may be made under the legislation.

5) How often you have judged you can levy these enforcement notices per breach

We do not hold any information on this point.

6) How many enforcement notices you have served under the Energy Performance of Buildings (England and Wales) Regulations 2012, how many were paid, and whether you plan to increase your enforcement of this legislation as a means to then trigger the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015
